Keep reining in lawsuits
It's good to be No. 1, but the recent study that found Texas tops on tort liability reform also ranked Texas in the bottom 10 for actually stopping abusive legal practices in the state ("Good riddance to 'law west of the Pecos'"). And that's the real crux of the problem in Texas. We have passed real and meaningful civil justice reforms, but we still have rogue jurisdictions and courts where lawsuit abuse and unbalanced justice persist.
The areas — dubbed "judicial hellholes" by the American Tort Reform Association — continue to serve up uneven justice, approve questionable legal theories and hand down astounding monetary verdicts. Ultimately, they taint every reform Texas passed — often by simply ignoring the laws.
In Texas, we can certainly be proud of our efforts to rein in frivolous and abusive lawsuits. But our work here is far from done.
