Texas cap on medical malpractice awards

According to the Dallas Morning News, a federal judge ruled Tuesday that a Texas law limiting noneconomic damages in medical malpractice cases to $250,000 is constitutional. The aforementioned law caps the amount that plaintiffs in medical malpractice cases can be awarded, specifically for pain and suffering, emotional distress or loss of quality of life. Caps on noneconomic damages in medical malpractice cases help lower doctors’ liability rates and improve Texan’s access to health services.  To read the full article from the Dallas Morning News, click here.
