Ridiculous Lawsuit Against McDonalds Gets Thrown Out

At TALA, we always keep in mind the people we are fighting to protect from abusive lawsuits—responsible citizens, small business owners, working professionals. Without these good and productive people, the economic health of our state would suffer.

On the other hand, it is disheartening to see the sort of people and cases that opponents of legal reform regularly defend. Look no further than this ridiculous lawsuit from San Francisco. In this exceptionally frivolous case, a mother filed a class action lawsuit against McDonald’s for including toys in her child’s Happy Meal, arguing that the toys entice children to eat poorly. The plaintiff complained, "What kids see as a fun toy, I now realize is a sophisticated, hi-tech marketing scheme that's designed to put McDonald's between me and my daughters."

Fortunately, the district judge had the good sense to throw out the case immediately.
